Welcome to Madonna Heights Residences. By choosing to reside with us, you agree to abide by the following terms and conditions, which are designed to ensure a comfortable, safe, and harmonious living environment for all tenants.
General Information
Name of Hostel: Madonna Heights
Purpose: Providing student accommodation in Embu, fostering a vibrant, enriching, and secure living experience.
Booking and Payment
Booking Process: Rooms can be booked via our website or by calling Madonna Management, whose contact information is available on the homepage.
Payment Terms: Rent is due by the 5th of every month on a monthly basis.
Deposit: A refundable deposit is required at the time of booking. The deposit is refundable at the end of the tenancy, provided all terms are met.
Late Payments: There are penalties for late payments, Late payment attracts a penaltyt of 10 percent as per terms andconditions in the lease agreement.
Accepted Payment Methods: Payment is either bank transfer as adviced by management from time to time.
Booking Withdrawal and Cancellation
Confirmed Booking: A booking is treated as confirmed once the deposit and the rent amount have been received by Madonna Heights. From that point the unit is reserved in the tenant's name and is withdrawn from availability to all other applicants.
Withdrawal Fee: Where a tenant withdraws their tenancy after the deposit and rent have been sent, for any reason whatsoever, a withdrawal fee of KES 1,000 shall be charged and deducted from the amount refunded to the tenant.
Reason for the Fee: Money received into our account attracts transaction and tax charges that cannot be recovered once paid, and Madonna Heights forgoes the opportunity to allocate the unit to another tenant for the entire period the unit is held on the withdrawing tenant's behalf.
Balance Refund: The balance of the deposit and rent, after deduction of the withdrawal fee, is refunded in accordance with the refund process set out under Termination and Refund Policy below.
Acknowledgement: This fee is disclosed on the booking page before any payment is made, and is accepted by the tenant at the point of submitting the booking form.
Room Allocation and Use
Allocation: Rooms are allocated on a first-come, first-served basis.
Occupancy: Each room is for single occupancy unless otherwise specified.
Room Maintenance: Tenants are responsible for maintaining their rooms in the condition they were provided. Any damage must be reported and may incur charges unless a valid appeal is made.
Facilities and Services
Internet and Water: Internet and water are provided. Tenants are expected to use water responsibly.
Security Measures: Surveillance is in place for security purposes. Footage may be used as evidence in cases of any incident.
Conduct and Responsibilities
Behavior Standards: Tenants must maintain a considerate attitude towards neighbors and respect the premises and staff. Disciplinary action may be taken for violations.
Prohibited Actions: Smoking and alcohol consumption are strictly prohibited. Violations will result in immediate termination of tenancy agreement.
Safety and Security: Tenants are responsible for securing their rooms. The hostel is not liable for losses due to tenant negligence.
Conflict Resolution: Tenants are encouraged to resolve conflicts among themselves. Serious issues should be reported to management.
Maintenance and Repairs
Reporting Issues: Maintenance issues should be reported immediately. Repairs will be handled by Madonna Heights Management as per the lease agreement.
Tenant Responsibilities: Tenants must ensure their rooms are well-maintained and report any damage promptly.
Termination and Refund Policy
Notice Period: A one months' notice is required for contract termination and the deposit will be refunded as per lease agreement.
Refund Process: Tenants should discuss the refund process with the landlord.
Withdrawal Before Occupancy: Where a tenant withdraws after the deposit and rent have been sent but before taking occupancy, the Booking Withdrawal and Cancellation terms above apply and the KES 1,000 withdrawal fee is deducted from the refund.
Safety and Security
Security Measures: Surveillance is in place for safety. Footage may be used in case of theft, property damage, or criminal offenses.
Tenant Duties: Tenants must secure their rooms and report any suspicious activity.
Legal Disclosure
Disclosure of Information: The hostel may disclose tenant information if required by law or to protect the rights, property, or safety of the hostel, its tenants, or others.
User Rights
Opt-Out: Tenants can opt out of promotional communications at any time.
Update/Correct Information: Tenants can request updates or corrections to their personal information.
Data Deletion: The hostel will keep user data as long as a tenant resides in the hostel, Upon request tenant data may be deleted.
Legal Disclosure
Effective Date: These terms are effective as of July 30, 2024.
Changes to Terms: The hostel reserves the right to change these terms at any time. Notice of changes will be posted, and continued use of the premises indicates acceptance of the updated terms.
